PARTY WALL RIGHTS

Rights in party walls can arise as a result of an agreement between the adjoining landowners or by common law.

Usually party wall agreements relate to the following issues:  (a) who will construct the wall and (2) who will contribute to its repair and maintenance.  Sometimes there are circumstances where there is no party wall agreement.  A developer may erect row houses and sell them off individually without any specific covenants relative to the party walls.  Sometimes one neighbor gives the other oral permission to attach one structure to the other.
