Intangible Tax:Intangible taxes must be paid on security deeds, amendments &  Modifications of security deeds.  The rate for intangibles is $1.50 per $500.00 or $3.00 per $1000.00 or fraction thereof

 

  • *Intangible taxes are due on security deed due in 3 years or more.

  • *Intangible taxes are not due on loans due in less that 3 years OCGA 48-6-61.

  • *Intangible taxes are not due on loans that state due on demand.

  • *If the grantee is a government agency (licensed in the State of Georgia or federal credit union), not taxes are due

  • *In a modification of a security deed, intangible collector must verify that all intangible taxes due, were paid on the previous filing, the modification agreement must have an intangible tax stamp.

  • *If not recorded within 90 days, penalties and interest due in the amount of 50% of the original intangible tax, interest is 12% per year, OCGA 48-6-77.

  • *The modification or amendment should include the book and page number of the original amount of the loan, the date of execution of the loan and the due date of the original loan.

  • *If a multi county or multi county state transaction, an affidavit of values and percentages should be included.

Judgment: For a real estate judgment: $10.00 for the first page/$2.00 for each additional page

Limited Partnership: $60.00

Transfer Tax: The rate for transfer tax is $10.00 per $1,000.00 and 10 cents for each additional $100.00 or fractional part.  This is exclusive of the value of any lien or encumbrance existing prior to the sale and not removed by the sale.  No tax is due on conveyances with a value of less than $100.00.  OCGA 48-6-1  Transfer tax must be paid before a deed is recorded.  OCGA 48-6-4 (b)

Trustee Deed: $10.00 for the first page/ $2.00 for each additional page

Warranty Deed: $10.00 for the first page/ $2.00 for each additional page
